Helping Trucking Companies And CDL Drivers Stay Compliant

NEED HELP NAVAGATING THE CLEARINGHOUSE?

The Clearinghouse is a new Federal Motor Carrier Safety Administration (FMCSA) database that contains information pertaining to violations of the U.S. Department of Transportation (DOT) controlled substances drug and alcohol testing program for holders of CDLs.

Clearinghouseservices.com has been formed to help motor carriers and owner-operators stay in compliance with the requirements of the Clearinghouse which took effect on January 6, 2020.

​Employers who do not comply with the FMCSA requirements are subject to the civil and/or criminal penalties set forth at 49 U.S.C. 521(b)(2)(C) (i.e., civil penalties not to exceed $2,500 for each offense). The Drug & Alcohol Clearinghouse was created by an act of Congress requiring DOT FMCSA to create the Clearinghouse Online Database.

Clearinghouse Services will help employers stay compliant.

Services available include:

Complete guidance and consultation to help employers navigate through the Clearinghouse.

Providing for employers the required annual query to determine any violations.

Provide for employers the required reporting of positive alcohol tests and employer-determined refusals to test.

Provide for owner-operators access and reporting requirements to the Clearinghouse.

Assistance to Drivers to correct any inaccurate information contained in the Clearinghouse.

Services – our MRO’s are ready to report information about positive drug test results and refusals to test to the database. (This will be required of MRO’s as of 01/06/2020).

Employers

Employers have five main obligations regarding the Clearinghouse:

1. Queries of new drivers

2. Annual queries of all existing drivers

3. Reporting alcohol test positives, employer-determined refusals to test and actual knowledge, as defined in Part § 382.107

4. Reporting negative return to duty tests and completion of follow-up testing programs

5. Updating policies and education programs to notify drivers of what information will be reported to the Clearinghouse

Employer Memberships

Drivers

FMCSA covered drivers with drug & alcohol testing violations will be reported to the new Clearinghouse.

The new Commercial Driver’s License Drug and Alcohol Clearinghouse is a database that will house information about driver positive drug and alcohol tests and refusals to test.

Employers hiring new drivers will be required to query the clearinghouse database to determine the driver’s eligibility for a Federal Motor Carrier Safety Administration (FMCSA) covered position.
